Assistance for Responding Parties and Respondents

Under College policy, the "responding person" is any person alleged, through a report to the Title IX Coordinator, to have engaged in prohibited conduct. A "respondent" is any member of the College community who has been alleged of violating College policy and whose responsibility for this violation is determined through a formal complaint process.

While the resources below were created for students seeking resources, the Title IX Office is also available to assist employees in making reports and filing formal complaints. Please reach out to Interim Title IX Coordinator Jill Moffitt at (610) 328-8304 or titleix@swarthmore.edu.

ASSISTANCE

Free, confidential counseling services through Counseling and Psychological Services (CAPS).
Supportive measures, including changes in housing or academic assistance, through the Title IX Office.
Dispute resolution, consulting, legal counsel, restorative practice and training through collaborative practices like Klancy Street.
Education and training through community organizations.

ADDITIONAL INFORMATION FOR RESPONDENTS

Respondents will be notified by the Title IX Coordinator, or their designee, if the College seeks action that would impact them. These actions can include no contact agreements, requests to participate in adaptable remedies (i.e. education, counseling), or the initiation of an investigation.

If applicable, respondents will receive a timely notice of the charges against them and will be provided with a meaningful opportunity to respond to those charges. Learn more about the procedures for resolution of complaints against students here.

Respondents may identify witnesses and submit evidence during the investigation and adjudication of the complaint. Respondents will receive updates on the status of the investigation and written notice of the outcome of the process.

The College recognizes that retaliation can take many forms and that a respondent may also be the subject of retaliation by another individual, including the complainant. Anyone who attempts to use bullying or intimidation to retaliate against someone who reports an incident, files a complaint, or participates in an investigation in an attempt to influence the student conduct process will  be in violation of retaliation as described within the student handbook and will be subject to disciplinary action.

Respondents will be assigned a Case Manager who is trained to assist respondents throughout the Title IX process. The Case Manager can help the respondent navigate the Title IX and College-Defined Sexual Misconduct Policy and respective procedures, and may accompany the respondent to any meeting/hearing related to resolution procedures.

In addition to the Case Manager, the respondent may have an advisor of their choice to provide personal support through the process and may attend any official meetings related to the process. If a respondent within a Title IX process is unable to procure an advisor they are comfortable with, the College will provide one for them.
